Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the
GiftCard Exchange website and services (the "Service") operated by
GiftCard Exchange Limited ("us", "we", or "our").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
GiftCard Exchange provides a platform for users to sell their gift cards in exchange for cash or cryptocurrency. We act as an intermediary between gift card sellers and buyers, facilitating secure transactions and providing competitive exchange rates.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. Identity Verification
To comply with anti-money laundering regulations and ensure the security of our platform, we require users to complete identity verification (KYC) before they can receive payments. This may include providing a government-issued ID, proof of address, and other verification documents.
5. Gift Card Requirements
You represent and warrant that: (a) you are the legal owner of the gift cards you submit; (b) the gift cards have not been stolen, forged, or obtained through fraudulent means; (c) the gift cards are valid and not expired; and (d) you have the legal right to sell the gift cards.
6. Payment Terms
Payments are processed after successful verification of gift cards. Processing times may vary based on payment method and verification requirements:
- PayPal: typically instant
- Bank Transfer: 1-3 business days
- Mobile Money: instant to 30 minutes
- Cryptocurrency: 10-30 minutes
7. Exchange Rates
Exchange rates are displayed in real-time on our website and are subject to change without notice. The rate shown at the time of transaction submission is the rate you will receive. We reserve the right to adjust rates based on market conditions, card type, and other factors.
8. Fees
We do not charge any fees for selling gift cards. The rate you see is the rate you get. However, your payment provider (bank, PayPal, mobile money) may charge their own fees for receiving funds. We are not responsible for these third-party fees.
9. Refunds and Disputes
All sales are final once payment has been processed. If your gift card is declined during verification, no payment will be made. If you believe there was an error, please contact our support team within 72 hours of the transaction for investigation.
10. Limitation of Liability
In no event shall GiftCard Exchange Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
11. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of GiftCard Exchange Limited and its licensors. The Service is protected by copyright, trademark, and other laws of both Nigeria and foreign countries.
12. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
